A Trademark or Service Mark is any word, name, symbol, device or any combination thereof used by a person, or which a person has a bona fide intention to use in commerce to identify and distinguish his or her goods, from those manufactured or sold by others and to indicate the source of goods or services, even if that source is unknown. The primary functions of trademarks are to identify the origin of the goods or service which the trademark is affixed and to provide and to assure quality. A trademark is a property right which may be proteceted under both state and federal statutes, as well as the common law.
Trademarks can be words, letters and numbers, slogans, a color or combination of colors, musical notes, fragrance or "trade dress" (a product feature such as shape, texture, size, color and packaging, as long as it is nonfunctional).
